1. Agreement
These terms are an agreement between you and INSPIRED BEACH LIMITED (“Inspired Beach”, “we”, “us”). They apply to inspiredbeach.com and our mobile games unless a product provides separate terms. By using a service, you agree to these terms. If you do not agree, do not use the service. Pulseora is governed by its own terms of use.
2. Eligibility
You must be legally able to enter this agreement. If you are under the age of legal majority where you live, a parent or guardian must review and accept these terms for you. Some games or features may have additional age requirements.
3. Limited license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use our services for lawful, non-commercial entertainment, subject to these terms and the rules of the store where you obtained an app. We and our licensors retain all rights not expressly granted.
4. Acceptable use
You may not interfere with a service or another person’s use; bypass security or access controls; use cheats, automation or exploits; reverse engineer except where applicable law expressly allows it; scrape or harvest data; impersonate another person; infringe intellectual-property or privacy rights; or use a service for unlawful, harmful or commercial activity without written permission.
5. Virtual items and purchases
Some games may offer in-app purchases, subscriptions, virtual currency or digital items. They are licensed, not sold, have no cash value outside the service and may not be transferred unless we expressly allow it. Prices, taxes, payment, cancellation and refund handling are governed by the applicable app store and mandatory consumer law. A store may process your payment and provide us with entitlement status, but we do not receive your full payment-card details.
6. Advertising and third-party services
Some games may contain advertising, links, surveys or integrations provided by third parties. Their terms and privacy policies apply to their services. We are not responsible for third-party sites, content or services that we do not control.
7. Ownership
Our games, website, names, designs, software, artwork, audio, text and other content are owned by Inspired Beach or its licensors and protected by intellectual-property laws. “Apple” and “App Store” are trademarks of Apple Inc.; “Google Play” is a trademark of Google LLC. Other marks belong to their respective owners.
8. Availability and changes
We may update, balance, suspend or discontinue a service or feature, subject to applicable law. Mobile services depend on compatible devices, software, networks and stores. We do not promise that a service will always be available, error-free or compatible with every device.
9. Disclaimers
To the fullest extent permitted by law, services are provided “as is” and “as available” without warranties of uninterrupted operation, fitness for a particular purpose or non-infringement. Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by law, Inspired Beach and its directors, employees and providers will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data or loss of goodwill arising from a service. Our aggregate liability will not exceed the greater of the amount you paid us for the relevant service during the preceding 12 months or €50. These limitations do not apply where prohibited, including liability that cannot be limited under consumer law.
11. Termination
You may stop using a service at any time. We may suspend or terminate access if you materially breach these terms, create risk or legal exposure, or where a service is discontinued. Provisions that by their nature should survive will remain effective.
12. Governing law
These terms are governed by the laws of Spain, without overriding mandatory consumer protections that apply where you live. Any dispute will be handled by the courts with jurisdiction under applicable law. Please contact us first; we will try to resolve concerns informally.
