Terms of use

1. Agreement

These terms are an agreement between you and INSPIRED BEACH LIMITED (“Inspired Beach”, “we”, “us”) for the Pulseora iPhone app. By downloading, purchasing or using Pulseora, you agree to these terms and the applicable App Store rules. If you do not agree, do not use the app.

2. Eligibility and device requirements

You must be legally able to enter this agreement. If you are under the legal age of majority where you live, a parent or guardian must review and accept these terms. Pulseora requires a compatible iPhone, supported iOS version and permissions for features you choose to use. Some features may be unavailable if permission is denied.

3. Wellness use and limitations

Camera-based heart rate, HRV, stress, energy and heart-age outputs are wellness estimates. Results can be affected by motion, finger placement, lighting, circulation, device condition and other factors. Reference zones, questionnaires, articles, recipes and suggestions are educational and may not be appropriate for your circumstances.

Pulseora must not be used for emergency decisions, diagnosis, treatment, medication changes or continuous monitoring. If you feel unwell, receive a concerning result or have a medical question, contact a qualified healthcare professional. For an emergency, call your local emergency number.

4. Your records and responsibility

You are responsible for the accuracy of manually entered blood-pressure, blood-sugar, weight, profile and other information. Check important records against the original source. A generated PDF is a convenience copy, not a certified medical record. You decide whether and with whom to share it.

5. Pulseora Pro subscriptions

Pulseora may offer weekly and annual auto-renewable subscriptions that unlock the same Pro feature set. Available products, localized price, billing period, introductory offer and eligibility are shown by the App Store before purchase.

• Payment is charged to your Apple ID when you confirm.
• A subscription renews automatically unless canceled at least 24 hours before the end of the current period.
• Apple charges renewal within 24 hours before the current period ends.
• You can manage or cancel in your Apple ID subscription settings.
• Introductory offers are available only to eligible subscribers as determined by Apple. Using one offer in the subscription group may make you ineligible for another.
• Refund requests are handled by Apple, subject to its policies and applicable law.

Deleting the app does not cancel a subscription.

6. License and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Pulseora for lawful, non-commercial wellness purposes. You may not interfere with the app, bypass purchase or security controls, copy or redistribute its content, reverse engineer except where law expressly permits, use automated extraction, or use Pulseora to violate another person’s rights or applicable law.

7. Privacy

Our Pulseora privacy policy explains local storage, camera processing, Apple Health, purchases, sharing and deletion. You are responsible for securing your device and for the destinations you choose when exporting information.

8. Intellectual property and third-party content

Pulseora, its software, visual design, text, content and trademarks are owned by Inspired Beach or its licensors. Health references, external sources and Apple services remain subject to their owners’ rights and terms. External links are provided for convenience and do not mean we control or endorse every linked statement.

9. Changes and availability

We may improve, change or discontinue features, content or subscription offerings, subject to applicable law. We do not guarantee uninterrupted, error-free operation or compatibility with every device or future iOS version. Material changes to these terms will be reflected by a new updated date and, where appropriate, an in-app notice.

10. Disclaimers and liability

To the fullest extent permitted by law, Pulseora is provided “as is” and “as available” without warranties of medical accuracy, uninterrupted availability or fitness for a particular purpose. Inspired Beach is not responsible for decisions made in reliance on wellness estimates or manually entered information.

To the fullest extent permitted by law, Inspired Beach and its directors, employees and providers are not liable for indirect, incidental, special, consequential or punitive damages, lost data, lost profits or loss of goodwill. Aggregate liability related to Pulseora will not exceed the greater of the amount you paid for Pulseora during the preceding 12 months or €50. Nothing limits liability or consumer rights that cannot legally be limited.

11. Apple terms

Apple is not responsible for Pulseora or its content and has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as provided by App Store terms. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the provisions relating to them.

12. Governing law and contact

These terms are governed by the laws of Spain, without overriding mandatory consumer protections that apply where you live. Courts will have jurisdiction as determined by applicable law. Before starting a formal dispute, please contact us so we can try to resolve the issue.
